Peru Regulatory Landscape: New Chemical Framework, GHS, Waste and Imports

July 2026 update: Supreme Decree 005-2026-MINAM was published in April 2026, but the regulation enters into force six months after publication, during October 2026. Obligations will be phased in, with an adaptation period projected through 2031.

Peru is undergoing a structural change in chemical management. The new framework combines hazard classification and communication, a national register, risk assessment and control, sanitary and environmental authorizations, dangerous-goods transport, waste management, and product-specific import controls.

1. Legislative Decree 1570 and the new chemical regulation

Legislative Decree 1570 approved the Integrated Chemical Management Law. Supreme Decree 005-2026-MINAM approved its regulation and establishes duties for manufacturers, importers, and users. Core mechanisms include the GHS, the National Register of Chemical Substances, risk assessments, and control measures across the life cycle.

2. GHS, labels and safety data sheets

When the new regulation enters into force, chemical hazard classification and labeling will follow harmonized criteria. The manufacturer is responsible for classification and labeling, while the importer must ensure compliance for commercialization and use in Peru. Companies should align composition, classification, pictograms, signal words, hazard statements, precautionary statements, and SDSs.

3. RENASQ and substance traceability

The National Register of Chemical Substances will be a central pillar of the system. Companies should begin organizing chemical identity, CAS number where applicable, composition, uses, volumes, hazard classification, suppliers, and importers. Operational details and implementation calendars will be phased, making regulatory monitoring essential through 2031.

4. DIGESA, SENASA and sector controls

Certain products remain subject to sector authorizations. DIGESA maintains procedures for industrial and professional-use chemicals, disinfectants, household and public-health pesticides, and substances under the PIC procedure. Imported products may require full composition, a free-sale certificate, safety information, and a draft label. Agricultural pesticides are registered and controlled by SENASA.

5. Transport of dangerous materials and waste

Supreme Decree 021-2008-MTC and its amendments regulate road transport of dangerous materials and waste. Compliance may cover transport classification, documents, packaging, marks, vehicles, operators, emergency planning, and the duties of consignors, carriers, and consignees.

6. Solid waste and circular economy

Legislative Decree 1278 and Supreme Decree 014-2017-MINAM structure integrated solid-waste management, prioritizing prevention, minimization, recovery, and proper final disposal. Duties vary by generator, waste type, hazardous characteristics, sector, and waste operator.

7. Imports and restricted goods

Restricted goods require authorization from one or more competent authorities. The national tariff subheading should be assessed together with the regulatory product category. VUCE centralizes many applications for permits, certificates, and licenses, while DIGESA, SENASA, and other agencies issue control documents according to the goods.
